Terms of Service

Welcome. These Terms of Service (“Terms”) govern your use of the Great Little Cars website and the services we provide through it, including browsing inventory, saving searches, requesting test drives, submitting credit applications, placing deposits, and completing vehicle purchases. By using our site or services, you agree to these Terms. If you do not agree, please do not use the site.

These Terms do not replace the separate contracts you sign when you buy a vehicle, finance a purchase, or trade in a car. Those contracts control the specific terms of that transaction. If there is a conflict between these Terms and a signed purchase or financing contract, the signed contract controls for that transaction.

1. Acceptance of These Terms

By accessing or using the site, you acknowledge that you have read and understood these Terms and agree to be bound by them. We may update these Terms from time to time. If we make significant changes, we will update the “Last updated” date and, where appropriate, post notice on the site. Continued use after an update means you accept the updated Terms.

2. Eligibility

You must be at least 18 years old to use the site, create an account, place a deposit, or enter into a vehicle purchase. You must be at least 21 years old to submit a credit application or enter into a financing agreement in New Mexico. By using the site, you represent that you meet the applicable age requirement and that the information you provide is true, accurate, and complete.

3. Accounts and Sign-In

You do not need an account to browse our inventory. You do need an account to place a deposit, submit a credit application, upload deal documents, or track an active deal.

We use a passwordless “magic link” sign-in flow: you enter your phone number, we send you a one-time sign-in link by text message, and tapping that link signs you in for up to seven days on that device. You are responsible for keeping your phone and email secure and for any activity that occurs under your account. If you think your account has been used without your permission, contact us right away.

4. Vehicle Listings, Pricing, and Availability

We work hard to keep our inventory, photos, specifications, and pricing accurate. Even so, listings are provided for informational purposes and are subject to change or error. Specifically:

• A vehicle shown on the site is not guaranteed to be available. Cars sell, get moved for service, or are held for other customers.
• Prices, fees, options, mileage, and specifications are subject to change and to verification at the dealership.
• Photos may not reflect the exact vehicle or may be taken before reconditioning.
• We reserve the right to correct errors, to refuse any sale, and to cancel transactions based on obvious pricing or listing errors.

5. Credit Applications

When you submit a credit application through the site, you authorize Great Little Carsand the lenders we submit your application to (credit unions, banks, and other finance sources) to obtain a credit report and verify the information you provide. We act as your agent in submitting your application to lenders. Final credit decisions are made by the lenders, not by us, and any approval is subject to the lender's conditions. We do not guarantee approval, rate, term, or monthly payment.

6. Deposits

You can place a refundable deposit (typically $100) to hold a specific vehicle while you complete your deal. Unless the vehicle's listing or your deposit confirmation shows a different hold period, deposits are refundable within a three-day hold window.

• If you decide not to purchase during the hold period, we will refund the deposit to the original payment method.
• If you complete the purchase, the deposit is credited toward the purchase price.
• If the hold period passes without a completed deal, the hold on the vehicle ends and we may release the car to another customer. We will refund the deposit.
• Refunds are processed through our payment processor and typically take three to ten business days to appear on your statement.

7. Pricing, Fees, and Taxes

The advertised price of a vehicle generally does not include state and local taxes, title and registration fees, a New Mexico dealer documentation fee, or optional add-ons you choose (for example, an extended service contract). These amounts vary by deal and will be disclosed on your final purchase contract before you sign. Financed deals may also include lender fees and finance charges.

8. Trade-Ins

If you submit information about a vehicle you want to trade, understand that:

• We do not give instant online offers. Your trade is appraised by a human on our team, based on the information you submit and, when appropriate, an in-person inspection.
• Any number you see on the site before appraisal is an estimate, not an offer.
• A final trade-in value is only binding once it is written into a signed purchase agreement.
• You represent that you own the vehicle or are authorized to trade it, that your disclosures about condition and history are accurate, and that any remaining loan balance can be paid off through the transaction.

9. Test Drives

To take a test drive, you must have a valid driver's license and valid auto insurance. We may ask for copies of both. Test drives are at the dealer's discretion and may be denied or ended for any lawful reason. You agree to drive the vehicle carefully, to obey all traffic laws, and not to take the vehicle outside the area we agree on. You are responsible for any citations, tolls, or damage caused by your negligence or misuse during a test drive, to the extent permitted by law.

10. Vehicle Condition — Used Vehicles and “As-Is”

Most used vehicles we sell are sold as-isunless a written warranty or service contract is specifically provided with the vehicle. The federal Buyers Guide (FTC Used Car Rule) posted on each vehicle at the time of sale controls the warranty terms for that vehicle. If the Buyers Guide says “As Is — No Dealer Warranty,” the dealer assumes no responsibility for any repairs after the sale, and no oral promise, statement, or implication overrides that written designation. If a warranty or service contract is offered, its written terms control.

11. Financing Terms Are Not Guaranteed

Any financing illustration on the site (payment calculator estimates, rate ranges, term examples) is for general information only. Real loan terms depend on lender approval, your credit, the vehicle, your down payment, and other factors. Nothing on the site is an offer of credit.

12. Acceptable Use

You agree not to:

• Provide false, misleading, or fraudulent information (including on a credit application).
• Impersonate anyone else or misrepresent your affiliation with anyone.
• Interfere with or disrupt the site, attempt to gain unauthorized access to any account or system, scrape inventory in bulk, or use automated tools to place deposits or submit applications.
• Harass, abuse, threaten, or defame our team or other users, including through any messaging feature on the site.
• Use the site for any purpose that is unlawful or prohibited by these Terms.

We may suspend or terminate access to the site or to any account that violates these Terms, with or without notice.

13. Intellectual Property

The site, including its design, text, graphics, photographs, logos, the “Great Little Cars” name and brand, and all other content (other than vehicle data provided by third parties), is owned by Great Little Cars or its licensors and is protected by copyright, trademark, and other laws. You may view and use the site for your personal, non-commercial use of shopping for a vehicle. You may not copy, reproduce, republish, or create derivative works from our content without our written permission.

14. Third-Party Services

The site integrates with third-party services (for example, payment processing, text messaging, credit bureaus, vehicle history providers). We are not responsible for the content, policies, or practices of third-party services. Your use of a third-party service is governed by that provider's own terms.

15. Disclaimers

The site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, with respect to the site itself and any information posted on it. We do not warrant that the site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that inventory information is free of errors.

This section applies to the website and its content. It does not limit any express written warranty or service contract provided with a specific vehicle at the time of sale.

16. Limitation of Liability

To the fullest extent permitted by law, Great Little Cars and its owners, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the site, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of those damages.

Our total liability to you arising out of or related to the site and these Terms is limited to the greater of (a) the amount of any refundable deposit you have paid to us for a specific vehicle, or (b) one hundred dollars ($100). This cap does not apply to liability that cannot be limited under applicable law, and it does not limit the rights and remedies you have under the signed purchase or financing contracts for a specific vehicle.

17. Indemnification

You agree to defend, indemnify, and hold harmless Great Little Carsand its owners, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the site, your violation of these Terms, your violation of law, or your infringement of any third-party right.

18. Governing Law and Venue

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of or related to these Terms or your use of the site is the state and federal courts located in Santa Fe County, NM, and you consent to the personal jurisdiction of those courts.

19. Dispute Resolution

Before filing a lawsuit, both sides agree to try in good faith to resolve a dispute informally. Contact us at info@greatlittlecars.comwith a description of the issue and what you would like us to do. If we cannot resolve it within sixty (60) days, either party may file a claim in the Santa Fe County, NM courts described above.

20. Miscellaneous

• Severability. If any provision of these Terms is held unenforceable, the rest remain in force.
• No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
• Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
• Entire agreement. These Terms, together with our Privacy Policy and any signed purchase or financing contract, are the entire agreement between you and us regarding the site and its services.
